India’s Supreme Court has directed authorities to prevent illegal detention of peaceful protesters and ensure the free movement of people in Delhi amid escalating demonstrations against Chief Election Commissioner Gyanesh Kumar. The court’s intervention follows widespread detentions and security restrictions imposed during protests organised by the Cockroach Janata Party (CJP).

A bench of Justices Joymalya Bagchi and V. Mohana also directed authorities to review barricades, maintain normal metro and railway services wherever public-order conditions permit, and ensure that internet access remains undisturbed, subject to applicable law.

The demonstrations have raised concerns over alleged irregularities in electoral-roll revisions and demands for accountability from the Election Commission. Police had detained thousands of people as security measures disrupted transport and access to protest locations.

The Supreme Court stressed that peaceful assembly and public movement must be governed by constitutional safeguards and lawful restrictions. It clarified that detentions must follow established legal procedures, particularly for peaceful, unarmed gatherings outside areas where prohibitory orders apply.

The directions mark an important judicial intervention in the dispute, placing the focus on balancing public safety with citizens’ fundamental rights to peaceful protest, movement and access to justice.
